Delhi High Court Cracks Down on Trademark Infringement: “CROMPTON” Brand Misuse Faces Strict Judicial Action

In a significant legal development reinforcing intellectual property rights, the Delhi High Court has granted an ex parte ad interim injunction in favour of Crompton Greaves Consumer Electricals Ltd., delivering a strong blow to counterfeiters and trademark infringers.
The Hon’ble Court has restrained multiple defendants from manufacturing, selling, advertising, or dealing in products bearing the trademark “CROMPTON” or any deceptively similar mark, trade dress, packaging, or branding. The scope of the injunction has been expansively defined, covering not only physical goods but also digital and commercial misuse.
In a comprehensive order, the Court prohibited the unauthorized use of the “CROMPTON” mark across trade names, domain names, keywords, metatags, and any form of online or offline commercial identifiers. This reflects a robust judicial stance against evolving forms of trademark infringement in both physical and digital marketplaces.
Further strengthening enforcement, the Court directed major e-commerce platforms to immediately remove all infringing listings, advertisements, and promotional content associated with the mark. Platforms have also been instructed to disclose complete details of sellers engaged in such unlawful activities.
In a forward-looking move, the Court incorporated a dynamic injunction mechanism, granting liberty to the plaintiff to notify additional infringing websites. Upon such notification, these platforms are to be promptly blocked or suspended, ensuring continuous enforcement without repeated litigation.
To safeguard crucial evidence, the Court appointed Local Commissioners with wide-ranging powers to visit the defendants’ premises, conduct search and seizure operations, prepare detailed inventories, and document findings through photographs and videography. They have also been authorized to examine financial and transactional records linked to the infringing activities.
The seized goods, as per judicial directions, have been released on superdari, subject to further orders of the Court.
Observing a strong prima facie case of trademark infringement and passing off, coupled with the likelihood of irreparable harm to the plaintiff’s brand reputation and goodwill, the Court emphasized the necessity of immediate interim protection and restrained the defendants from continuing any infringing operations.
This landmark order underscores the judiciary’s increasing vigilance in combating counterfeit trade and protecting established brands from misuse in an increasingly complex commercial ecosystem.
